And what happens if negotiations stall?
If we can’t reach an agreement through direct negotiation, we may suggest mediation. Mediation involves bringing in a neutral third party – a mediator – who helps facilitate discussions and guides both sides towards a mutually acceptable resolution.
Mediation often proves successful because it allows for open communication in a less adversarial setting. According to the American Bar Association, over 80% of cases that go to mediation result in a settlement.
