Upon your death, the trust automatically distributes your assets to your designated beneficiaries according to your wishes, bypassing the probate process altogether.
Consequently, a revocable living trust offers several advantages. It ensures privacy, as the terms of the trust are not part of public record like a will. Moreover, it can help minimize estate taxes and provide for loved ones with special needs without jeopardizing their eligibility for government benefits.
How does a Revocable Living Trust protect assets from creditors?
While a revocable living trust doesn’t inherently shield assets from creditors during your lifetime, transferring assets into an irrevocable trust can offer more robust protection. An irrevocable trust is one where the terms cannot be changed once established. This means you relinquish control over the assets placed within it.
Ordinarily, when someone files a lawsuit against you, they can seek to seize your assets to satisfy a judgment. However, assets held in an irrevocable trust are generally considered beyond the reach of creditors because you no longer have ownership or control over them.
It’s important to note that transferring assets into an irrevocable trust should be done with careful consideration and legal guidance. There are potential tax implications, and it’s essential to ensure the trust is properly structured to meet your specific needs.
I recall one instance where a client came to me facing significant debt. By establishing an irrevocable trust and transferring certain assets into it, we were able to protect those assets from creditors and provide him with some much-needed financial security during a difficult time.
