Interview with Steve Bliss: Navigating Probate in San Diego

Introduction

Good evening San Diego! I’m here with local probate attorney Steve Bliss from San Diego Probate Law. Mr. Bliss, thanks for taking the time to speak with us today.

Providing Notice: A Crucial Step in Probate

Steve, let’s talk about the process of providing notice during probate. Why is this step so important?

“Providing notice is fundamental to ensuring transparency and fairness throughout the probate process,” explains Steve Bliss. “It’s essentially informing all interested parties—heirs, beneficiaries, and known creditors—that a probate case has been initiated.”

He continues, “Consequently, this allows them to protect their rights and interests. For instance, heirs need notice to understand how the estate will be distributed, while creditors have a specific timeframe to file claims against the deceased’s estate.

Moreover, publishing notice in a local newspaper three times ensures that any potential unknown creditors are also made aware of the probate proceedings.”

Challenges and Triumphs

Steve, are there ever challenges with this step? Can you share an example?

“Absolutely. I recall one case where locating heirs proved exceptionally difficult,” Steve says, his tone reflecting a mix of empathy and professional satisfaction. “The deceased had estranged family members who lived in different states and hadn’t been in contact for decades. Tracking them down required meticulous research and the help of private investigators. It was a long process, but ultimately we were able to connect with all the rightful heirs and ensure they received their due inheritance.”

The Importance of Accuracy and Timeliness

“Notably, according to a study by the American Bar Association, improper notice is one of the leading causes of probate delays,” Steve points out. “This underscores the importance of working with an experienced attorney who understands the legal nuances and can ensure all notices are accurate and timely.
