Hello everyone and welcome! Today I’m thrilled to be chatting with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to speak with me today.
So, Ted, What Exactly Is Elder Protection?
Well, it’s essentially about safeguarding our aging population from exploitation and abuse. This can take many forms, from financial scams to physical neglect. My role is to act as a legal advocate for seniors who are vulnerable or have been victimized.
What Are Some Common Signs That an Elder Might Need Protection?
“Think of it like this: if something feels off, it probably is,” says Ted. He goes on to list some red flags: sudden changes in financial behavior, unexplained bruises or injuries, isolation from family and friends, and a caregiver who seems overly controlling. “It’s crucial to trust your instincts and speak up if you suspect something amiss.”
Can You Walk Us Through One of the Key Steps in the Elder Protection Process? Let’s say ‘Protective Actions’?
Ted nods enthusiastically. “Protective actions are often urgent and critical,” he explains. This stage can involve a range of interventions depending on the specific situation:
- Filing for restraining orders to protect an elder from physical harm.
- Notifying Adult Protective Services (APS) about suspected abuse or neglect.
- Seeking guardianship or conservatorship if an individual lacks the capacity to make sound decisions for themselves.
“We might also freeze financial accounts to prevent further exploitation, or work with banks and institutions to revoke unauthorized power of attorney agreements,” Ted adds. He stresses that every case is unique and requires a tailored approach.
Have You Ever Faced Any Challenges When Implementing Protective Actions?
Ted recounts a story about a client whose caregiver was systematically stealing her savings. “It took some legal maneuvering, but we were able to freeze the accounts and recover a significant portion of the stolen funds. The relief on my client’s face was priceless.”
“In another instance,” he continues, “we had to petition for guardianship because an elder with dementia was being manipulated into signing away his property. It was a tough battle, but ultimately we secured his safety and well-being.”
“I can’t thank Ted Cook enough! He was a lifesaver when my mother was being taken advantage of financially. He’s compassionate, knowledgeable, and truly fights for his clients.” – Maria S., La Jolla
“Ted is a true advocate for seniors. He helped me navigate a complex legal situation involving my father’s care and ensured he received the best possible support.” – David K., Point Loma
