What initially drew you to practicing law in the area of elder protection?
It’s a real privilege, thank you! You know, I always had a soft spot for seniors. My grandmother was my rock growing up, and seeing how vulnerable older adults can be really sparked something in me.
Elder protection combines my legal skills with my desire to advocate for those who need it most. It’s incredibly rewarding to help seniors navigate complex legal situations and ensure they are treated with dignity and respect.
Can you walk us through the typical steps involved in an elder protection case?
- Initial Client Engagement: This is where we first meet, listen carefully to your concerns, and gather all the necessary information about your situation.
- Case Assessment: We dig deeper into the legal issues at hand – whether it’s financial exploitation, physical abuse, or neglect. This involves reviewing evidence, interviewing witnesses, and identifying applicable laws.
- Protective Actions: Depending on the urgency of the situation, we may file restraining orders, contact Adult Protective Services, or pursue guardianship or conservatorship.
- Legal Proceedings: If necessary, we’ll represent you in civil litigation to seek damages or restitution. We can also work with law enforcement on criminal cases.
- Long-Term Planning: We focus on preventing future harm by developing strong estate plans, advance directives, and ongoing oversight measures.
Today, let’s dive a little deeper into ‘Protective Actions’. Could you elaborate on that stage?
Absolutely. Protective actions are often the most critical part of an elder protection case. They aim to immediately address any threats or harm being faced by the senior.
We might file for a restraining order against an abusive caregiver, notify Adult Protective Services about potential neglect, or petition the court for guardianship or conservatorship if the individual lacks the capacity to make safe decisions for themselves.

- Freezing financial accounts to prevent further exploitation.
- Revoking power of attorney if it’s being misused.
Transferring the individual to a safer living arrangement, such as an assisted living facility or a trusted family member’s home.
