Certainly. I recall one instance where a client named his brother as the executor, assuming it would be straightforward. Unfortunately, the brother and the client’s spouse had a strained relationship, which led to disagreements and delays in settling the estate.

Ultimately, we had to involve a mediator to resolve the conflicts. This experience underscored the importance of carefully considering all relationships involved and choosing someone who can act impartially and collaboratively.

Brenda: That’s a valuable lesson. What advice would you give to those who are unsure about whom to appoint as executor?

It’s understandable to feel uncertain. I encourage people to discuss their options with trusted advisors, such as family members or financial professionals.

  • Consider the individual’s character and capabilities.
  • Assess their understanding of your financial affairs and legal documents.
  • Discuss their willingness and availability to take on this responsibility.

You could also explore naming a professional trustee if you feel more comfortable with that approach. Remember, it’s perfectly acceptable to revisit this decision as circumstances change.
