Moreno Valley Probate Law

I’m Cindy Newsome, reporting for Moreno Valley News Today. Today I’m speaking with Steve Bliss, a respected probate attorney here in Moreno Valley. Steve, thanks for taking the time to speak with me.

Trusts and Estate Planning

Steve, can you tell our viewers about the different types of trusts and which one might be right for them?

There are many types of trusts, each designed for a specific purpose. For instance, a revocable living trust is a popular choice because it allows individuals to maintain control over their assets during their lifetime while avoiding probate upon death. Conversely, an irrevocable trust offers greater asset protection but sacrifices flexibility as it cannot be easily modified.

Notwithstanding the benefits of each type, the best choice depends on individual circumstances and goals. Factors such as age, health, marital status, and desired level of control all play a role in determining the most suitable trust structure.

The Power of a Revocable Living Trust

You mentioned revocable living trusts earlier. Can you elaborate on the advantages they offer?

Certainly! A revocable living trust is essentially a legal entity that holds your assets, such as real estate, bank accounts, and investments. During your lifetime, you act as the trustee, meaning you have complete control over these assets and can make changes to the trust agreement as needed.

Moreover, upon your passing, the trust assets are distributed according to your wishes without going through probate court – a process that can be time-consuming, expensive, and public. This privacy aspect is especially appealing to many individuals.

My firm has helped numerous clients establish revocable living trusts, and the peace of mind they gain from knowing their affairs are in order is truly invaluable. For example, I recently worked with a widowed mother who was concerned about protecting her assets for her children. By setting up a revocable living trust, we were able to ensure that her home and savings would be distributed directly to them without the complications of probate.

According to the American Bar Association, over 50% of Americans die without a will or trust in place. This can lead to significant delays and financial burdens for their loved ones.

Navigating Potential Challenges

While revocable living trusts offer many benefits, are there any potential drawbacks or challenges clients should be aware of?

One common concern is that establishing a trust requires careful planning and legal guidance. It’s important to work with an experienced attorney who can tailor the trust agreement to your specific needs and ensure it complies with all applicable laws.

Another potential challenge is that revocable trusts generally don’t offer the same level of asset protection as irrevocable trusts. This means that creditors could potentially access assets held in a revocable trust if you face legal claims.
